Hi,

Chairman in on behalf of Society has filed complaint u/s 406 of IPC against Ex-Chief promoter. Now, new managing committee had filed compounding application before metropolitan magistrate, where ex-Chairman expressed his desire to continue, hence compounding was rejected. So, this managing committee has filed  quashing proceedings in Bombay High Court for compounding the offence. In High Court ex-Chairman has opposed this move and as member he want continue the proceedings.

Is there any citation from Supreme Court/laws in MCS Act, by which ex-chairman is allowed to continue the proceedings and not to compound the offence?
