Marksheets correction through agent

I gave my BSc. 2nd and final year marksheets with Rs. 1800 to an agent for correction. Now it's been nearly 10 months and He hasn't returned the marksheets yet. When I call him, He does not receive or reject the call. How can I take legal action against him?
