Managing committee not giving structural audit report......

Hi,

I stay in housing society since last 27 years, I am having dispute upper floor member about ceiling. I made number of complaints in last 6 years to the last MC, however, MC favored uppper member and they delayed the society structural audit and they were not allowed me to do separate structural audit. Also upper member refused to carry out separate structural audit.

Said member carried out his renovation work without carrying out any structural Audit. After his work gets over current committee has carried out structural audit of the society, I raised my complaint to the Structural auditor. New MC shared draft of structural audit where no cognizance of my complaint taken, therefore, I demanded final certified copy with stamp and signature of auditor with new MC, however, they are avoiding to provide the same by giving false excuses. What action should be taken to get Authorised Structural audit copy? In Last structural audit carried out by society, the final audit report circulated to all members.

Also in EGM, i demanded to provide full copy of structural audit, however they failed to record the same in minutes. In said EGM they passed certain contribution amount for doing structural repairs. However, without having final structural audit copy in my hand, how could I pay the contribution amount?

The new committee in hand in glove with old committee causing delay to my problem. WHat action I should take?

You can report the matter as your grievances to the Dy registrar of Co-operative society and seek it's intervention.

If they fail to respond within a reasonable time you may escalate the matter through court of law to get your grievances redressed.

After seeking certified copies of all (relevant) records from the MC / Society you may submit your complaint to State Registrar Cooperative Societies through a local prudent lawyer.

Now Managing Committee ready to give copy and asking undertaking from me that 

1. That the audited report is a confidential document belonging solely to the Society, and I shall maintain absolute confidentiality of its contents at all times.
2. That I shall not copy, circulate, disclose, publish, photograph, or share the report or any part thereof, in any form (physical, digital, or electronic), with any individual, group, or third party without prior written permission from the Managing Committee.
3. That the document shall remain in my personal custody and control, and I shall take all necessary precautions to prevent loss, theft, misuse, or unauthorized access.
4. That I shall return the document within __ hours from the time of issue, in the same condition as received.
5. That I shall be fully liable and responsible for any loss, damage, leakage, misuse, or unauthorized disclosure of the document or its contents during the period it remains in my possession.
6. That in case of any breach of this undertaking, I agree to indemnify the Society for any loss, damage, legal consequences, or reputational harm arising therefrom, and I understand that the Society reserves the right to take strict legal action against me under applicable laws.
 
I am executing this undertaking voluntarily, with full understanding of its implications.

Is it OK? or will it affects further actions taken by me after getting the said report

You can give the undertaking. After getting the report you can do whatever you wanted to do. Such undertakings are unenforceable. They can do nothing.

But Secretary not willing to give structural audit report directly to me, he is keeping structural audit report in security cabin.... In short, he is avoiding to provide me correct version of Structural Audit Report, so later he can deny his responsiblity

You issue a legal notice through a lawyer to the secretary demanding your requirements, failing to comply you can escalate the matter through legal sources against the secretary

You have a complaint against the upper floor member regarding the ceiling. You have not stated what exactly is the problem. The upper floor member or the Society or both may be at fault regarding the problem. You address the problem rather than chasing the structural audit report. The upper floor member may be responsible, the Society may be responsible or both may be responsible. You first try to solve the problem directly contacting the upper floor member and the Society. If you do not get solution go to the co-operative court if you are in Maharashtra or go to the civil court depending on the State in which you are. If the structural audit is relevant to solve your problem, it will automatically come before the court. Ceiling of your flat and not structural audit is your problem .
