Maintenance charges payable in case of reslae

Hello,

 

I have purchased resale 2 BHK in pune last year from a seller. We have done agreement to sale and sale deed in which we have agreed that Seller will pay maintenance charges till sale deed and after that it will be my responsibility to pay maintenance charges. When i taken possession , society was not formed and residents were contributing 1000 per month for maintenance. Once society formed, society is asking me to pay 50K (which builder taken from previous owner) but not given to society fund.

Before possession we have taken NOC from builder which clears no dues from owner side but builder is saying there is no maintenance fees provided. My agreement and sale deed already having clause that i am not responsible for any maintenance or charges before my possession but society is threatening me to pay 50 K otherwise they will not provide me share certificate and society facilities.

Will they can take any legal action against me?

Please help
