Respected forum,
We have just formed an association in our building after taking possession from the builder. From April onwards we are collecting the maintenance charges from the residents and running the place. The builder is in possession of 3 flats still and has not sold it. When asked, he refuses to pay the maintenance charges claiming that since the flat is not sold he is not liable to pay.
Can someone tell me if its legal ? isnt he entitled to pay ? In all probability he is keeping possession to encash more at a later stage.
