why there is a special court for deciding land grabbing cases inspite of civil court  having the jurisdiction to try such matters.

dear it is the prerogative of the state to establish spl courts keeping in view the nature and intensity of the matter.

 

spl courts r often established....may be in corruption matter.

Very Good Idea this is. Because, many illetrate people are being affected by land grabbers i.e., land grabbers sold the land of another person. Grabbers having more money after selling another person's land and facing everying with that money. But, the looser of the land should spend again to institue a suit for declaration of null and void the sale deed.

Moreover, the looser of the land ought to pay court expenses like advocate fee etc., and further, they have to wait for a long time to redeem their land. Whereas, the grabber will have sufficient money to go to even Supreme Court.

Hence, Finally, Land grabbing is double loss to the actual owner of the land grabbed by the land grabber.

Further, such land grabbing can be stopped by the following suggesstion:

That the Government can appoint an advocate in each and every Registrar office.

 

Parties those who are intended to transfer their land ought to get "LEGAL OPINION" from that advocate.

 

The registrar should register all transfers based on the advocate's opinion. such power should be given to the registrar.

 

The said advocate should be liable for any consequences of the said registered transfered deed.

 

This would be the proper way to prohibit the land grabbing instead of constituting a speical court for land grabbing.
