There is an act called Building and Other Construction Workers Act 1996. This act has not been completely enforce in all states of India. For which the Supreme Court of India adjudicating the issue to implement the same in all states.
Query:
Anyone help me that is there any recent judgement by Hon'ble Supreme Court of India that the contractor's are not liable to pay the labour cess if the said act was not implemented or implemented by the State Government during the execution of the project.
If he is supposed to pay the labour cess, it will come under subsequent legislation changes as per FIDIC conditions of Contract.
