KUL KAYADA (KUL law)

Dear Sir,

I have a 01 plot measuring 2000 Sq Ft  given to a pers on lease from 02 years. He is giving me in written on 100/- stamp paper that every year that he had taken a plot for lease for 01 year and I wish to give the same as long as he required.

I wish to know that is there is any hidden risk is there that he will grab it? If I want to lease the same for 10-15 years, how to lease it legally so that he shall be there but not in the position to grab it under kul kayada (maharashtra)?

Lease Deed for more than a year has tobe got registered and stamp duty paid accordingly.Not advisable to lease on mere stamp paper of  rs.100.

If you want The provision of Transfer of Properties Act should not be attracted the deed should be for less than 1 year (i.e. 365 days) i.e. for less than 364 days or less than 11 Months and 29 days ( in case of leap year add a day).
