You hv not told as to what's yr job profile n whether u r working in a Pvt firm or so.

If u r working in a Pvt co., n in the management category, try to find out what's is the cause for asking for yr resignation. If it's for non-performance/unsatisfactory performance, the management can ask for yr resignation.

If that's the case it's better to go with a good touch by submitting resignation n taking all the terminal benefits.

Dear querist,

You can find some job within notice period or if company terminates you in that case you can challenge the termiation in labour court.

It is difficult to get black and white answers in such situation. He himself is the best person to decide for himself.

If the employee does not want to get into litigation and spend his valuable time and money, then he can wisely give resignation and try looking for better opportunities.

Otherwise, he is free to do (almost) anything.
