In a particular complaint by 1 complainant against 3 accused persons, if one of the accused, say accused no.2, is tortured by the other two accused out of vengeance for getting caught and spoiling the crime done together by the accused persons, while being out on bail, and by that torture accused no.2 dies then,

 

Will the death of accused no.2 amount to offence on part of other accused..??

 

In what way can the rest of the two accused be prosecuted for the death of accused no.2, apart from they getting prosecuted for the offences alleged against them in the complaint by the complainant..??

 

Will it be complainant’s responsibility to prosecute the other two accused  ...for playing roles in death of accused no.2?

 

Will it be state’s responsibility to prosecute the other two accused for playing role in death of accused no.2??

 

Considering the present complaint being tried at the trial court, for the new offence of having role in the death of accused no.2 do the other two accused need to be prosecuted at the sessions court…??

 

The complainant has some witnesses/ evidences against the other two accused persons proving their roles in the death of accused no.2, in what way can the other two accused be punished for having their roles in the death of accused no.2 on the basis of those witnesses/ evidences…??

 

Will it be complainant responsibility to again lodge a complaint in the sessions court now…??

 

Please guide in what way can the other two accused be punished…and under what IPC…??
