Increment after suspension during enquiry

As per service rules, the enquiry shall be completed, and if any punishment is given, that punishment period also shall be completed, and then only you can get the increments.  Judgement copy is not available.  Search kanoon.in or in the column of judgments of this forum.

If you are aggrieved by the decision of the department you may first exhaust the remedies within the department's top management after which you can approach Administrative tribunal for remedy and releif.

File your representation in the form of appeal before department with relevant records.

Your increment in Jul 23 could not be released as one year qualifying service was not complete.  Again the increment in 2024 could not be released as one year qualifying service was not here complete from Jul 23 to Jul 24.

Please confirm whether this is the reasons given by deptt?

To my knowledge, the period of six months makes the employee eligible for increment. As such you ought to have been granted increment due on 1st of July 2023 (but effective from date of revocation of suspension in the month of October) and 1st July 2024.

You may submit a statutory appeal/representation highlighting that, though eligible, withholding increment amounts to infliciting a penalty through the backdoor with out following the due process of law.

In case of no favourable decision, you have option in seeking judicial review before the Admonistrative Tribunal/High Court.
