My cousin’s causes trouble and police visits my home

Dear all, My father took my cousin in as a child because his father died at very early age. My father provided education, home and every other thing we have been given to him along with his name for education purpose. But now his misdeeds are coming back at is police keep coming to our home and ask for him even though he is married and made a home for himself in the village. This time police has come and threatened us that if he doesn’t appear in the station they will do kurki of our home. I need suggestions and help to tackle this situation.

Your father should inform the police that he do not have any relationship with him and he is out of our  homw in a village settled with his wife.

If the police is still visiting and threatening your father then he can very well approach high court with a petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking direction to police to not to harass.

What is complaint against your cousin for which police has come ?

Seek professional services of a local prudent lawyer if there is some real problem.

Things do not appear to be as simple as narrated by you . 

 

You have mentioned that police is repeatedly visiting your house and threatened auction of the house.

 

This gives a reasonable impression that :-

 

1.       Your cousin is wanted.

2.       He is successfully evading.

3.       You and your father are pretending to be unaware of his whereabouts (not a new thing for the police).

4.       Police seems to be frustrated due to deadlock  and is on the verge of losing cool.

 

Police knows  how to locate a fugitive criminal and how to extract information of his whereabouts from family members.

 

Your query is not clear :-

 

                                                 (i)            What is the nature and gravity of crime committed by your cousin.

                                               (ii)            Whether or not your cousin has any share in the house you live.

                                              (iii)            Whether or not you  and your father gave his whereabouts to the police.

                                             (iv)            What was the last address of the fugitive.

                                               (v)            How your address came in the hands of police where you claim he does not reside there.

 

In case the futitive has even a slight claim in your property then Police can seek orders of its attachment and you will be called upon to vacate. If he has no claim on this property still you can be troubled to give  his whereabouts.

 

So, please do not take the matter as easy as you think.
