I have previously posted regarding my case for Blackmail & Extortion and I am thankful to all the Lawyers who have replied and helped in the case. I am again posting to know how to bring this issue to a closure. The present situation is as follows:
Let me give a brief introduction to the incident that took place in Jul, 2012. I met a girl who was working as receptionist for our hotel and fell in love with her and wanted to marry her and when I approached the girl she asked if i am serious or just want to have fun. I told her I was serious and wanted to marry her. Then she came up with a story saying she wanted 10 lacs to pay the house owner to buy the house for which they have already paid some amount and this was the final amount and she would pay back in 3 months as her sister in South Africa will send the money. I trusting her and to impress her took a loan myself and gave 5 lacs to her father after convincing the owner that the rest will be paid soon. After that in the course of courtship with her she herself admitted to having affairs before and likes to drink and even had s*x with men. At this point I decided that this kind of girl is not suitable for me nor is she suitable for my family. Then I told her that I am not sure about the marriage now as I did not know all this about you before and did not expect such a background from her. In meantime I had several rivals who are working in the hotel who know the whole issue and influenced her at this point and one of the receptionist influenced her so much that he even asked her to sleep with him in order to help her blackmail me into leaving the 5 lacs and even make me pay more to get rid of her. After that I came to know of the whole plot and knowing that I came to know, both of them left their jobs and started harassing with phone calls from her mother asking to settle the marriage issue which they know i clearly was not going to accept. After that we approached some mediators to go and talk to them and settle the issue about the money but they refused to pay back the 5 lacs and threatened to goto to the police if we did not pay another 5 lacs. Then we reported this matter to the police DSP and they were investigating and in one of the instances they called the receptionist who was sleeping with her to ask questions and the next day the girl and her parents went to the SP taking the local newspaper guys to launch a cheating case against me and that came in the paper also. What we did not want to happen actually happened, yes it was an embarrassing moment for me and my family but we did not loose our courage and launched a case for attachment to the new property they bought which her father owned and as he was the person I gave the money to and he signed the Pro Note and pledged his previous property which is inherited from his father to him as security for the loan. We got the attachment and they were taken aback when we launched this case and came for compromise after getting repeated notices from the court to respond to the case and came to meet my lawyer in his office and admitted that the girl has falsely put a case on me and that she was going out with that other guy and that he was the guy who encouraged them to put case and extract more money from me and not give the initial loaned amount also. They said that they cannot pay the whole amount but can pay 3 lacs and asked the lawyer to talk to us and negotiate the matter. Then my lawyer convinced them to goto to the police and admit to the false case in the DSP office and after that he could probably approach us about negotiation. They complied and went to the police and gave their statement. After that the cheating case was closed at the investigation level itself, but the thing here is that we only have the word of the Head Constable to go with and there is no document given to us to show that the FIR has been closed. Now it has been more than 1-1/2 years since this happened and they have not even paid the interest for the money and damaged my families name and my name in our society and caused so much of tension and chaos we are not willing to let go of any money although we did compromise on the Interest money and asked to pay back atleast the exact loaned amount that I gave them.
Now the issue is even if we agree to the negotiation and take the 4 lacs(which now they are willing to pay) how will I make sure that the girl will not launch a case again and blackmail me again for money as the statement given is only by her parents and not by her. Although the police say the case has been closed there is no documented evidence given to us to prove it. Is there a way to get a statement from the girl that all this is a false case and she was influence by other people to do this and there is no fault of me in the whole issue???
