house construction by elder brother

3 brothers are there , one constructed a huge house for his brothers but one of them constructed on the 1st floor and other constructed his other house. And now after the death of elder brother ,they want their share in the part of the elder brother ? In this case what will the court do ?even in the elder brother's share 3rooms have been taken by the other 2 brothers
