If the establishment works for 6days /week or less than 6days /week, then if employee has worked for 240/190 days in 5th year then employee is eligible.
So as per details posted by you employee should be eligible.

Did the employer supply ‘Notice of determination of Gratuity’ and payment of gratuity?
If employer has not supplied payment of gratuity within 30days for LWD then IT has to tender interest @10%pa for the delayed period.
Employee may submit FormI under proper acknowledgment to good offices of appointing authority,MD/CEO and mention that ‘Notice of determination of Gratuity’ and payment of gratuity has not been supplied till date despite representations in office/in person/by phone/email on dated……….to Mr/Ms…………
