garentor liability

just wanted to know... if a canvassing Agent be a garentor( who has given in writing on stamp paper of 50.Rs.and his company cheques) for the trader. (not in bank loan)... has the liability if the traders is not paying him the amount. where the Agent has given in writing and the cheques for security purpose...
