Property sale through gpa

Hi,

We are interested in buying a flat in bangalore. The flat is owned by two brothers - A & B. Mr A has underwent a surgery and is physically unable to travel and Mr. B is in USA. Now, they are proposing that the GPA is given to a person C. Mr. C is sign the sale agreement and Sale Deed.

Is this legal or is there anything that I need to consider. Please advise.

Thanks,

Akruthi

Dear Querist,

Though it is legal - tread with caution. Make sure the GPA in favour of C is registered, and as regards B since he is outside the GPA has also to be authenticated by Indian Consul in USA

Hi,

They are informing me that the GPA need not be registered as Mr. C is just going to execute the Sale Deed and all the money would be given to Mr A and Mr B. The GPA is just notarized. Is this okay? Please respond as this would help me decide whether or not to go ahead with the deal.

Thanks.
