Family property dispute

Hello SIr,

I am born and bought up in Kohima , Dimapur Nagaland. Post that I am working in Bangalore.

My father bought a property in 1985. Later my father expired in 2008 and we are two sister and me. But due to duispute , my father made a will there the property ownership before death that property me given  to me and my mother and my sister will have no right.

Later , my mother made the property document in her name without our knowledge. Post that , after many years without my knowledge she sold the property.

But we do not know whom the property is sold and without our knowledge the property was sold. Later after the property was sold , it was told to us. 

We want to file a case and which case we can file as I didnt want to property to be sold and I have not given any no objection for this tracsaction. 

We want to make the selling null and void. How to do that and what are the options , please suggest.

She fabricated a document executed in her favour by someone, and she sold it to someone. These documents are not valid, but you shall obtain evidence for these documents and file a declaratory suit.

How will I get the document , it was done without my knowledge. Can I file a case and if so what all cases should I file.

You can file a suit for partition and also seek an order to declare the sale deed null and void.

You can get the certified copy of the registered documents from the registrar office.

@ Hello God,

The property stated to have been purchased by your father and bequeathed will in  your favour belongs to you and no one else have any interest, claim, right or title in such property provided you had disclosed the  Will executed by deceased in your favour.

If your mother has fabricated some title documents and sold the property it is illegal, unathorised and invalid transaction, file a declaratory suit to decalre the transaction as null and void, through a local prudent lawyer, where property is located i.e., Kohima / Dimapur court of jurisdiction.

The WIll was executed in favour of me and my mother. It was both have the right excluding my sister.

But the transaction was done without my knowledge , consent or neither I have provided any NOC in this regard. We came to know after the transaction was done. It was done in colusion with my sister and her husband and her husband's brother. The transantion deed is done.

What are the legal option ? WHat all I can do ? Can we make the legal document null and void. Or file case against them,

What is the stand of your mother on the issue?

Who is in possession/occupation of the property? Has the mutation been carried out in the revenue/municipal records based on the lleged transaction?

Regarding stand of my mother ,  she behaved as step mother , as she she didn't inform regarding this and she wanted to sell this. I was in opposition to that. 

I am not sure whether mutation has been carried or not.  Currently I am staying in Bangalore due to job purpose. I am looking for a  property dispute lawyer who can help me.
