No, If a case has been filed under 498A IPC, then the police can't give bail Its a cognizable, non bailable, non compoundable offence. One has to seek bail from Court.

Dear V.Mehta,

For 498a You cannot seek bail from the Police as our beloved and learned Advocates have pointed out. But the Supreme Court of India has directed clear cut ways befroe arrest and such the Police cannot/ will not arrest anyone as easily as they did earler. If you are very firm in your being clean, away from the accusation  and bold  enough you can face Police enquiry. They are also ready to listen to you if you could cooperate them ( barring a few Police men, whom we do no consider at all) and there shall be no need for them to arrest you if they prepare the list as directed befroe the arrest. This is based on the recent judgment. Dr.R. Stephen Louie, Advoacte- 9444587777, Madras High Court

Before Arnesh vs State of Bihar, station bail was not possible...however, in TS atleast, people are getting station bail. Even I did not want to believe it...but since August, all of our new SIF members have been getting station bail for 498a.
