OTS with bank failed partly. Bank cancel the OTS. Consent decree filed in DRT. Is it possible to request DRT to direct Bank to continue with OTS and give extension of time, due to genuine difficulty in making payment of the agreed amount. The party is not a wilful defaulter. Circumstances led to the situation due to international market conditions. Is there any judgement on such issues.
