I have bought a property in Chennai for a consideration of Rs. 48 Lacs in June 2012. It is an old building G+2.
Proper Chennai Municipal Corporation approval for demolition and reconstruction of G+2 is got in October 2012.
Demolition commenced in October 2012. The neigbour living behind our building interferring with our demolition works and openly asking common passage rights transferred in his favour and then only he will permit us to proceed. The demolition works of 40% yet to be completed. The building is in a dangerous condition. A Police complaint was registered in December 2012. To register a complaint against him, the case is pending in Madras High Court and Advocate Commission has submitted its report regarding boundary which is as per Taluk Office Surveyor Sketch and confirmed we did not demolish any of his property. A suit is also pending in the City Civil Court for permanent relief. Meanwhile, during Court Holidays, a complaint registered with Commissioner of Police Chennai, stating all information with a copy to Chennai Municipal Corporation Commissioner. There is no stay for demolition. The neighbour is creating problem with my contractors when we works. We are getting this project through some relations. Since October 2012, My capital is locked and I do not know how to proceed, We want to construct building and live peacefully thereafter. In November 2011, we have got architect drawings and selected a Main Contractor.
Experts can guide us i) If any thing happen to building who will be held responsible ii) Can we start demolition with police protection and iii) Can we claim damage from my neighbour? and looking forward guidance.
