Exparte

The 2nd defendant was served with summons, but he not chosen to appear before this court, consequently he was proceeded exparte on 07122010. what does it mean ?

It means that even after proper service he voluntarily did not turned up and has nothing to say on the plaint. Whatever allegations as mentioned against him is accepted.

Exparty doesn't mean that whatever allegations are alleged is accepted.

 

It only means that court will proceed further without waiting for the response of the defendent no2,

 

 

So,petitioner still have to prove the allegations

On the given date, he can go and request the court to set aside the exparte proceedings if he is really interested in contesting it.
