exise act

     an appeal was preferred before exise commissioner under section 11 of u. p. exise act which was ultimatetely    allowed and matter was remitted back to collector for disposal on merit after providing opportuniy to adduce evidence.After expiry of three and half year collector is not deciding the same.Despitethe several application he is not deciding the same.The case is not yet registered in the mislband register.Kindly suggest me the remedy available in given situation.
