Employees compensation act

Dear All,

One of our employees met with an accident in and out of due course of employment.  He lost his thumb and doctor certified his disability as 30%.as Partial disablement.

We have already paid him compensation as per Section 4.  However there is a provision to escape this liability and pay half monthly payment to the injured workmen.under rule 4(d). i.e. :  a half-monthly payment of the sum equivalent to twenty-five per cent of monthly wages of the employee, to be paid in accordance with the provisions of sub-section (2).

How can we intepret this section and how the half monthly wages are to be calculated.  What is also the definition of wages to be taken into consideration for calculation of wages.

Requested to interpret and cite any case laws on the same.
