our chs held elections in 2007...in 2009 in agm they disolved n a adohh commitee was formed n decided this adohh commitee will held elections within sixmonths
after six months the adohh committee called spl agm to appoint returning officer
from members nobody was intrested to become RO n not to spend money for RO coming frm registar
a member proposed to adohh committee to continue term for five yrs n a another member second n a resolution was passed the same committee will run for 5 yrs
now in 2012 in agm meeting all members demanded for fresh elections n after long disscussion chairman declared electons with in three months and agm appointed RO
on 17th march 2013 elections were held...n in spl agm succesuful candidates were declared ....................
2 loosers who were existing M.C members after loosing hav put the matter in co operative court challenging elections as they say is they were having one more year of there tenure
my question is if agm declares elections.. is valid..,,as loosers say now .. the spl agm gave them term for five yrs was to be ended in 2014.. but they were not came through election process they were selected in spl agm which was not in agenda
n also they say that agm cannot appoint RO
i think term is for 5yrs ... election were held in 2007 then the nxt term should be in 2012 after loosing why they say this..
