Dear Experts,

I've filed an I.A. for Dismissal of O.A. on various grounds. The P.O. has ordered that since it involves many issues of importance, it would be heard along with the main application.

I filed Review against the internal order. But again the same response stating that the Application is alive and shall be heard with main application.

What are the mreasures & under which section by which the application can be heard as a preliminary issue and decided on merits?

generally wherein interim applications are filed  DRT invaribaly directs that interim applications will be heard at the time of final hearing to save time of the court . if courts keep on hearing interim applications presiding officer wont have time to hear final hearing matters .

If you are aggrieved against the Order of DRT in IA and also in Review application for deciding preliminry issues, then your only remedy is before D R A T, by filing a Miscellaneous Appeal under Sec. 20 of RDDB Act.
