Divorce initiation & settlement

What is the procedure to get divorce?

Is it (can it be) initiated by one of the spouse or both HAVE TO initiate it together?

If one of the spouse initiates, can he/she loose some credibility and/or financial settlement package? For example, if husband files for divorce first then he might have to pay somewhat more than normal amount (or %age) as settlement amount. Or if wife files first for divorce then she may get less than normal settlement amount.

Thanks in advance.

The divorce can be taken by any one after contest and if both are willing to get divorce then both can jointly file mutual divorce and it will be decided within 6 months. plz also explain your details.

Dear Mr. advocate,

Thanks for the answer though partial. Second part is underneath.

If one of the spouse initiates, can he/she loose some credibility and/or financial settlement package? For example, if husband files for divorce first then he might have to pay somewhat more than normal amount (or %age) as settlement amount. Or if wife files first for divorce then she may get less than normal settlement amount.

If this is the case then it might discourage the individual from going ahead and file for divorce. One couple is in this situation, meaning that none of the spouse is taking the courage to file for divorce though they know that they can't live together (this is their final decision).
