Divorce case

Hi,

Is it possible to withdraw the divorce case filled with the help of Interim affidavit, whether the opposite party oppose such moves.How to overcome the objections raised by the other side.

Why do U want to withdraw the divorce case?

Divorce case or for that matter any civil case can be withdrawn at any stage by plaintiff.But in case of criminal cases court can only close any compoundable offense framed on accused for example, cheating- section 420 CrPC.

You can withdraw your divorce case at any point of time before the Judgement.

What kind of the objections has been raised by the Opposit party by which you want to overcome?

Please note that filing a false Affidavit in the court is a Penal Offence and is punishable under the Indian Penal Code.

You can withdraw your divorce case and the opposite party cannot object it.

The opposite party can very object to your withdrawal petition if some issues are to be decided in the original divorce case

Agree with shri Kalaiselvan sir. If opposite party wants to settle some issue , they can object to withdrawal. But in general court cannot forecably hear a case.
