Divorce

Hi I had married in December 2017 and I want to give divorce to my wife so she can marry someone else I had informed this to her before marriage that if our marriage didn�t worked then we will go away from it. Tell me ways to end up this marriage 1. we mutually agreed and signed on stamp paper in front of lawyer - will it be ok 2. Or can we file MCD within 3 month of completion of marriage

For proper divorce by mutual consent you need to file joint petition under the Hindu Marriage Act, 1955 in the Family Court not before some idiot advocate suggesting you all this.

The petition for divorce by mutual consent can be filled on the condition that the parties are living separate for one year and want to dissolve the marriage with free will and consent.

Your marriage itself is not even one month old, you need to wait for one year and file for divorce by mutual consent under section 13B of the HMA, till than you both live separately and wait for correct time for moving the Family Court with help of experienced and learned lawyer only and get marriage dissolved by decree of divorce.

Till divorce complete no remarriage by either party. Marrying during existing marriage is null and void.

it is december 2017 only. marriage less tha a month.

You seem to be on a childish mission to apoil your life.

 

You nowhere stated whether she is willing for divorce.
