Disturbance by a church in the neighbourhood

Dear Sir,

 

There is a church next to my house.  I am not sure if they have permission as ours is a residential area, so far we have not signed any docs intimating our "no objection".    While we have no issues in them conducting just prayer meetings, they are creating lot of noise due to usage of drums and other music instruments.  I have  studying children at home who are not able to concentrate on studies due to this disturbance.  My mom is aged about 90 and cannot rest due to this.  Inspite of telling them not to create nuicance they do not seem to take it seriously.  Since we are most affected as we are the immediate neighbours and other neighbours do not seem to bother much.  Pl let me know how do go about taking action against this church.

File a Suit for mandatory injunction against the church, wherein the court would require the church to refrain from creating a nuisance. Agreed Constitution gives a right to practice & propogate religion - however the same is not absolute and there can be reasonable restrictions on the same. Use of loudspeakers etc is strictly prohibited. You can also file a suit for damages on account of this nuisance.
