custodial rights of Police

In case of non cognizable offencesections do Police department have a right to arrest or take the accused into custody without investigation.

FIR is a prerequisite for arrest. I'm not convinced that by issuing a notice Police can arrest someone for a non cognizable offence.pls clarify
