Hi,
I need to know, if the applicant(wife) can submit the examination-in-chief for 125 CrPC & DV case by the way of affidavit instead of deposing in the witness box? Is this legal? Should this affidavit be challenged in the lower court and subsequently in Session? OR should lawyer for accused start cross examination of the applicant(wife), accepting affidavit for examination-in-chief?
Can you please state correct law position on this and guide next course of action?
