Nonavailability of occupancy certificate

Dear friends,

I bought a ready built flat in Kolkata from a Developer about 4 years ago. I got SBI Home Loan, and the amount  was given (one time disbursement) to the Developer after registration of Sale Deed. Developer made some unauthorised constructions in the ground floor after selling out of all the flats, and has not applied to the local Municipality for Occupancy Certificate. We have launched complaints to the Municipality about 3 months ago, clearly pointing out the said unauthorised constructions and unwillingness of the Developer for OC. Yet we have not found any action from the Municipal Authority. Now what actions can we take against the Developer? Pls reply.

you may file an FIR against the builder for unauthorised construction. you may approach the municipal corporation for obtaining Occupancy Certificate as it is compulsory for obtaining water and electricity connection in the building.
