Contractual obligations

Can a matter pertaining to non performance of contractual obligations may be taken before consumer court or the same should be filed before MRTP. I understand that MRTP has been replaced by the Competition Act. What would be the proper remedy in such cases.

If u want that the second party should perform the conditions of contract then you should file a case in civil court for specific performance of contract. OR

If you want to claim damages/compensation then also you should approach the civil court.

If your company is falling within the ambit of 'Consumer', you can file the case at Consumer Forum.  Otherwise, Civil suit is the only other option.  If the agreement has any Arbitration Clause,  you can go for that.
