Contractual employee - eligible for gratuity ?

SIR,

IF A COMPANY EMPLOYES A WORKER ON CONTRACT BY EVERY YEAR CONTRACT RENEWAL YEARLY BASIS LIKE THIS

1.   FIRST FOUR YEARS EVERY YEAR RENEWAL

2.  FOR 5TH YEAR WORKERS DO JOB CONTINUOUS BUT COMPANY SIGNED FRESH AGREEMENT AFTER 3 MONTHS AFTER EXPIRY OF 4TH YEAR.

3. AFTER THIS EMPLOYEE WORK WITHOUT AGREEMENT UP TO 9TH YEAR

 

SO WHETHER HE IS ELIGIBLE AS COMPANY SAYS CONTRACT EMPLOYEES NOT COVERED UNDER PAYMENT OF GRATUITY ACT

PLS PROVIDE ANY SECTION OR CASE LAW IN THIS REGARD.

 

 

4 YEARS REGULAR BY EVERY YEAR CONTRACTED
