Company holding marks cards

Hello everyone i am working in a BPO company from past 6 months and now i feel this is not a right job for me so i want to quit my job but my company is holding back my 12th marks card and i hav signed an service agreement for 1 year and if i give resignation within 1 year i have to pay Rs 20,000/- is there any way i get get back my marks cards without paying the money. And it is mentioned in the offer letter that .Any default/failure to pay the above mentioned amount at the time of being relived from active service shall attract appropriate civil and criminal action as per applicable law.please help me out Thank you

If you have signed a service agreement for one year you need to abide by it, otherwise you will need to pay the penalty price of 20000 rupees as agreed by yourself.

Terms and condition of the contract are binding on both the parties as such you are bound by it.

The service agreement/Bond was crafted and created by employer  in lieu of what extra ordfinary favor to employee say; some certified training from some certified Instt. at employer's expenses and that added to qualification of employee?

If NO; and service agreement/Bond was crafted and created by employer for the employee to feel obliged ( Ehsaanmand) then it may be void, unconcienable,unreasonable, illgal, and may amount to bondage/bonded.

 

The employer has no lien on Marks shet\et/testamonials of employee.

Did employer ask thse to be retained by it in writing?

Did employer issue any acknowledgment?

 

What is the conduct of this empployer that rnders it unworthy of being employed with?
