Cash advance taken by driver

Hi Sir, My ola cab driver worked with me for 2 months and on 1 day he did an accident in PUNE BRT road where taxi cab not allowed to drive. That time drive promised me to settle the matter by providing hospitalization expenses to next party and promised to repay the amount in 1 year in parts. but now the driver has left duties after a month and now not coming for work neither returning money. I have sent registered notice on my letterhead but no response. Please advise

is there anything in writing that he will setle the matter? Inabsence of written commitment it is very difficult for you to recover the amount from him.

secondly he is acting under you in the capacity of Mater and servant relationship hence Master is liable for the lapses committed by the servant and viceversa.

thirdly The injured person is a thrid party hence if he files any claim under MV.Act you are liable to pay unless you have valid insurance policy and valid DL to your driver.
