their was a case filed on lower court for cheque froud in 2009, in june 2016 lower court(taluk) ordered to pay the said amount or will be convicted. then we got the stay temprory from the district court 3 months back, now the district court jurdge has given order to execute conviction sentense.
"Appellant absent. Learned advocate for respondent filed memo stating that appellant has not deposited amount to the court below as per the stay order granted on 15/06/2016 in this court. Learned advocate for appellant submits appellant did not turn up. Perused records. Appellant challenged conviction judgement of learned JMFC in CC No.55/2009. This court, in this appeal, granted stay order relating to operation of conviction judgment of the court below with certain conditions including the condition to deposit Rs. 1 lakh before the court below within 10 days from 15-03-2016 and also execute personal bond for Rs.50,000/- with a surety for likesum. But appellant has not complied said condition. Therefore benefit of stay order is not available to appellant. Hence, return LCR to the court below to execute sentence of conviction judgment, if it is found appellant not complied with conditions of stay order dated 15/036/2016 passed in this appeal and to re-submit LCR to this court after needful is done. But we have appealed a stay from high court and the case status is "Pending for Admission" . how to know how much time will it take to get the stay order from high court??
