case against municipality

Hi friends,

I am a co owner of  a property that is 40 years old and am in possession of a small shop on the ground floor.Now the other  co owner has spent a lot of money bribing the officials and illegally constructing extra floor without our permission or permission from the municipality. 

 We are skeptical if the building would take the extra load risking our life we have written to the municipality but they are not taking any action .

My question is who do i sue which would be of advantage to us...

1.against the municipality where we have written letter and also filed a rti and no reply has come from them and neither they are stopping the constuction.

2against  the other co owner who has stopped light and air due to illegal construction and the extra floor by which the load is increasing .

yes, you can file either writ or civil case against both of them.
