Caretaker basis

 

Sir,

I own a residential flat with a Co-operative Society at Mumbai. As it is vacant I wanted to give the said flat on rent i.e. Leave & licence basis.

I applied to society for the permission i.e. NOC as usual, but to my surprise the Society denied me permission  for the same  (although in the past the same society has been giving me permission for the past many years), now they say they can give me permission only for giving the flat on Caretaker basis.


With respect therof my questions are as follows:

1. Can I sublet/ Rent my flat on Caretaker basis and still get monthly rent from the other party i.e. the party to whom the flat is subletted ?

2. Can a Caretaker Agreement be registered ?

3. How different is it from Leave & licese ? Is it safe ? Would it create any right  of other party on my flat ?

4. Do I still need to take permission of Society for subletting/renting the flat on Caretaker basis?

5. Kindly provide me with a format/draft of  "Caretaker Agreement ?

6.Is there any other remedy for subletting/renting the flat ?


I would appreciate an early reply to my questions.

does giving a property on cartekaer create any sort of right in the property ?
