Can we file a case of defamation on police department

One person was arrested by police under the offence of fake currency/counterfeiting and later on same was acquitted by court. Now whether he can file a case of defamation on Police department as well as on witness or not?

Dear Mohit

you can filed a case against police but the police have defence that police officers was on duty and work as  public servent, but if you proved that the police officers and witnesses's intention not in goodfaith then your defemation case can be registered.

Aquital is not defamation . You have to prove the case of police as false . Aquital is not false., you have been let off on technical grounds.

Who is cops they are just public servant nothing more then that. There are only 2 kind of people. People who live with dignity and people who don't live with dignity.

This is not only about the dignity. The whole faith of nation is decide by only those people who can protect his dignity. If do compromise for once, then u have to do comprimise for the 2nd, 3rd .... And it will goes on.

Mohit: How many people have the guts to take on cops? Whatever sue them under 499/500 IPC. [Make only one cop an accused and not many as they'll all gangup].

it is next to impossible. 

how many prsons suceed iun gettng compensation for defamation? 

Everybody talk for Defamation claim " Ijjat ka dava thok dunga ek karodka, " but do not do it, ,

To get money, u have to file Sp. ivil Suit paing 6k for a lakh rs claim app,

ur sucees is doubtful, as u may not be able to prove damages or losses incurred to u,

tale a lot of truoble,

Police is not One or Two persons, Police is an establishment and a seperate organisation, if they want to pay back, that's just a Cat Walk for them. BUT Truth and Dharma has it's own way of dealing things, if you really want to fight for that, just ignore rest of the world, Aim those who did wrong in your case and hit without any hesitation. But remember, Keep every thing in black & white and get some support from Media and higher officials

It seems that my friends above have pent up FURY AGAINST THE COPS.

Well my friends for defamation one must have concrete grounds to follow in court.

If you have something concrete you must go ahead, Well as per your query it looks that you may have been framed in possesion of false currency notes U/s 489(A) IPC allegations were not  prooved  in court & you got aquittal. 

 If you have the proof that the police officer who investigated the case insulted you with malafide intentions, locked you up in a cell when knowingly that you were innocent & such illegal action of the police officer ruined your reputation in public eye & society,  then you must most certainly go ahead with complain in the court having jurisdiction.

All these are concrete evidence you need to prove in matter of defamation.
