The Delhi High Court has overruled a request by a petitioner's attorney that a judge should recuse himself from hearing his case. Appearing before a bench headed by Justice Pradeep Nandrajog yesterday, octogenarian N S Hoon humbly requested that being attorney of Pushpa Ahuja, he wanted his case to be released from his bench. When Justice Nandrajog asked Mr Hoon for reason, the latter expressed lack of trust in him. Mr Hoon further cited a previous case in the year 2002 when Justice Nandrajog had imposed a fine of Rs 50,000 on his client, a widow pleading for probate. The fine, Mr Hoon added, was promptly set aside by a division bench, which made no secret of its disappointment with the harsh treatment meted out to the hapless widow. Therefore, the attorney submitted that the history might repeat itself and hence the judge should release the case for another judge to hear. However, Justice Nandrajog did not buy Mr Hoon’s argument and set December 2 as the next date of hearing. |
