A Person XYZ, a government employee since 24feb 1994 in RMC on the post of ______. When his (first) wife demised, he had three kids that time. And then he goes against society and does the second wife without following any culture and increased the number of children from three to seven.
Meanwhile, he started violation of the fundamental rights of dignity and equality by descriminating and elienating from his first late wife children in order to keep the second wife happy in every ways like;
•in food - he didn't provided proper food not even a single glass of milk for good health and when the child asked for the milk, the child was beaten up by him(father) as he follows the order of his second wife.
So the children became poor physical health.
•in education- sent them in a gov school where the fee was cheapest ( about 120inr in a year) and even not provided proper books and copy, when the child asked for a copy, he gave a bundle of pages which were not even pinned but in the same time the other side, he gave a bundle of classmate copies and Cambrian public school for thier better futures and all.
So the children became poor mental health.
•in clothing- on the occasion/ festival, whenever the child asked for a new cloth and he became furious and beaten up the child badly by using any piece of hard object whichever he gets nearby and once he used a iron rod to beat and the child tried to suiside by taking a new good night liquid.
He planned to expell all the children ( who belongs to his first late wife) rights on his property so he bought a land on the name of his second wife in order to keep her happy.
He told us many times: if you all wants your rights then go and bring your mother. I don't care. jo karna hai kar lo...
We all brothers and sisters wants to ask from our supreme court ... Are we are illigal or adopted? if they can't give us justice.
Jo facts aapne bataye hain, unse clearly lag raha hai ki pehle marriage ke bachche sirf neglect nahi, balki actual physical aur emotional abuse face kar rahe hain. Yeh cheez unfortunately kaafi families me hoti hai, par law isko lightly nahi leta. Second marriage ho jaana ek alag cheez hai, lekin uske baad bhi father ki responsibility pehle waale bachchon ke liye kam nahi hoti. Basic cheezein jaise ki khana, books, school ki fees, normal upbringing ye sab uski legal duty ka part hai. Aur agar kisi child ko itna pressure diya ja raha ho ki wo suicide attempt kar le, to yeh situation immediate attention demand karti hai. Isme Child Welfare Committee ko approach karna ya police ko complaint dena bilkul valid option hai.
property issues me generally sabse zyada confusion hota hai. Dekhiye, first wife ke bachche legitimate heirs hote hain. Unka right second marriage se zero nahi hota. Agar property ancestral ya joint family nature ki hai, to unka share automatic hota hai. Aap unko bas kah kar remove nahi kar sakte. Self-acquired property me father koi bhi decision le sakta hai, par agar lag raha ho ki transfers sirf isi intention se ho rahe hain ki pehle waale bachchon ko hata diya jaye, to courts normally usko suspicious dekh kar scrutinize karte hain.
Seedhi si baat aap illegal nahi ho, aapke rights legally protected hain. Agar aap action lena chahein, to law definitely aapko support karega.
