Dear Sir/ Madam,
My grandfather & his two brothers were living jointly. My granfather was living at Native place and was farmer. His eleder brother was doing service at Mumbai whereas younger brother was depend on my grandfather.
My father brought land under " Kul Kayada" as he was farmer and living at Native place. All properties were in the name of my grandfather. In 1975 my grandfather got expired; even his two brother got expired before him.
My grandfather has five sons & one daughter; whereas his brother living at Mumbai has four sons and one daughter and his youbegr brother has one son.
After death of my grandfather, all property got registered in the name of my elder uncle. My elder uncle got expired in 2003. After my elder uncles death, all property got registerd in the name of elder Uncle's Son and daughter & wife.
After death of my elder uncle, the one of the nephew ( son of mubai residing brother of my grandfather )of my grandfather claim for his name to be added in property.
After getting history from Tahasil office, it was found that- my uncle who got expired in 2003 had already added the name of his four brothers( including my father), his mother ( my grandmother), his sister ( my aunty), his four cousins brothers( son of Mumbai residing cousin grandfather), his one cousin brother ( son of dependent cousin brandfather ) in 1984.
My question is that, in this situation, can my father & his alive brothers can take objection against the WILL which was made by his Elder brother ( expired in 2003) without consulting them.
Beacause all the property is gained by my grandfather and was in the name of my granfather.
As it was joint family earlier, my elder uncle may have added name of all his cousin brothers.
But now they are creating problems.
Please guide & lets know the best way to divide this property.
