Ancestral

my grandfather had a house of 2 acres. he had 5 daughters and 2 sons. during his last days he mortagaged the house.after his death his eldest son paid the amount and got back the house and registered in hte name of his mother,himself,and his brother. after my grandmothers death,the property was shared betweem two brothers and the grandmothers share was again divided between 5 daughters and 2 brothers. after the death of the eldest son the property was given for development. now the query is

1.the elder son has a daugher and a son.(ie, my father)

2.the younger son being a divorcee has no children.

my fathers share is enjoyed by my mother, son and daugher(myself)

my uncles share is enjoyed by him alone.now he is almost 80 yr old. he wants give the property to an outsider by writing a will on a minors name. who is not his son or his illegal son.my question is

1. can he write the property on an outsiders name whomhe says he has adopted(whereas in general he has not adopted leglly but he has helped him for his studies

2 if he dies intestate then wat happens to the property. who will be the next legal heir

3.the property which he own is in the form of apartments. if he writes a will on an outsiders name can we (his brothers children )being my grandchildren of my grandfather ,claim porperty or can we challenge his will?

4.after my grandfathers death my father played a major role in getting back the property, he has accumlated the money by taking loans etc, my uncle was 22yrs old and father was 25 . now as my father kept his gold,belogings,etc to pay the dues, can we challenge the will in the court after my uncles death.pls help
