We have identified a under construction property and paid Token of Rs. 20,000 and further agreed to pay Rs. 10L at the time of Agreement to sale and final balance at the time of Sale Deed. Now, we have identified that the apartment has more than 8 flats and needs RERA certification.
The Builder has agreed to apply for RERA but asked to make Agreement to Sale with 5L and balance 5 L can be paid after receipt of RERA Certification.
If RERA is not provided by the builder, the Agreement to sale shall be void and the Advance paid Rs. 5L + Token of Rs. 20000 shall be refunded.
If RERA is provided we shall pay Rs. 5 L and balance at the time of Sale Deed.
Kindly advise the proper clauses to include in the Agreement to Sale & can we proceed accordingly.
