Acquiring the property

My father had two wives. My mother's name is in Army documents as she was the first. I was born after second marriage. There is no any name of mine in Army documents of father as my father was in Army. Now my step brothers have registered ancestral property in their name only. Now I want to get my share of property. What should I do? pl help. I am a Central Government Civil employee.

Dear querist,

If your mother is first wife and you are legitimate son of your parent then you have all right in self acquired and ancestral property of your parents.

 

If your father did second marriage in while his first marriage was existing, children born from second marriage. There is no legal validity of second marriage and your step mother and step brothers have no right in any property.
