Accident in toll road

If there is an accident in a Elevated Toll Road - causing the death of the pedestrian, is the driver of the car/truck blame worthy  considering the foll facts :

1. The pedestrian has jumped the 3 1/2  foot  side wall of the 6 lane Toll way and was trying to cross the highway - where there is no crossing permitted,  where he was hit by the car/truk and died.

2. The Car/truk has to follow the minimal prescribed speed in the Express way, and can't anticipate a pedestrian in the expressway.

 

Which section/ Act supports that " An accident causing death of the pedestrian in a Toll way - the Driver of the vehicle can't be charged for Rash and Negligent driving"  - where the mistake is completely on the pedestrain only.

 

Pl advise..
