Society without possesion

Dears

The developer of our building have granted us letter for possesion to carry out furniture work about two years back. We have not got BMC connection for water supplies. The approach road leading to the said property is not ready. Due to this the developer has not provided us with final possession letter.

However now the builder has started taking signatures of the flat owners to form a co-operative society. All the flat owners have paid all the dues to the developer. So as the flat owners we are worried that once society is formed builder will not look into the issues related to road and BMC water supply. Hence OC and final possession letter will not be available.

Hence we would like o know once society is formed can developer run away from his responsibilites? Please advice.

After formation of society the builder shall hand over maintenance to the society but cannot escape his other liabilities for one year after handing over.

The society should withhold a substantial part payment to prevent him running away and shoulder his responsibility.
