As per the Gujarat HC Part IX B of the Constitution is ultra vires where as the Apex Court is relying on this PART in its delievries despite the appeal pending for disposal. Now, how to proceed with PART IX B of the Constitution in framing Acts, Rules and Bylaws in this connection?
